Plaintiffs brought actions for South Carolina, North Carolina, and Georgia FedEx Ground delivery drivers seeking recharacterization of their status from independent contractor to employee and for payment of wages and expenses. We were able to show that the climate and culture of an employer encouraged the consumption of alcohol and led to a horrific motor vehicle crash. A company supervisor left a bar after an evening of drinking and crossed the center line on a rural road colliding head-on with a husband and father, killing him. The company gave its employee around the clock access to a company vehicle while knowing he was using the vehicle after hours to frequent bars and drinking establishments.

Brain Injury to Medical School Student Caused by Drunk Driver

A highly intoxicated driver caused a high-speed collision blocking all lanes on a busy bridge. Our client was struck in a rear end collision caused by the chaotic accident scene created by the drunk driver. She suffered orthopaedic injuries and brain injury that interrupted her studies as a medical student. We were able to show from security footage that the driver had been served a large number of alcohol beverages at a local bar/restaurant immediately before the crash.

Our client was seriously injured in a collision when he was rear-ended by a tractor trailer. We were able to establish in discovery that the truck driver had lied about his experience to secure the driving job but the trucking company had failed to check his claims of experience. The trucking company also continued to put the driver on the road despite receiving alerts of continuous and consistent violations of state law and unsafe driving. Our client was a star basketball player who played alongside Alex English at the University of South Carolina. He played professional basketball for a short time and then played pro ball internationally for a number of years before he began a coaching career. Our client was enjoying a summer ride on his motorcycle when a tractor trailer suddenly changed lanes without checking the mirrors. Our client was struck, sending him airborne. He suffered numerous fractures and other severe orthopedic injuries and could no longer play or coach basketball. He suffered memory and concentration deficits, personality changes, hearing loss, sleep disruption and depression. After significant discovery was completed, the trucking company responded to a policy limits demand by paying the full coverage.

Our client was a 35-year-old mentally-disabled individual who was a long-time resident of a state psychiatric facility. He lost his life when he was suffocated to death beneath a pile of staff members who failed to follow their training on physically restraining patients. The settlement included not only the monetary award but a commitment for systemic improvements, including enhanced community crisis response teams, expanded community housing, and improved staff-to-patient ratios. A department of mental health music room was also named in honor of this special patient.

Death of Minor by Suicide after Abrupt Cessation of Treatment due to Bad Faith Denial of Health Insurance Benefits

Our client was a minor suffering from a behavioral health disorder. His inpatient treatment abruptly ended when his health insurance carrier denied further benefits. Shortly after discharge the troubled young man ended his own life.

Breast Cancer Missed by Radiologist

A jury awarded $6.9 million to our client when her breast cancer treatment was delayed because a radiologist failed to recognize early breast cancer on her mammogram. The delay in diagnosis allowed the otherwise treatable cancer to spread and metastasize to other parts of the patient's body. After a two-week trial, the jury awarded the patient and her husband a $6.9 million dollar verdict.

When our client was scheduled for a tooth extraction, his family physician failed to use an appropriate bridging protocol for his blood thinners. As a result, he was taken off of blood thinners for a time and suffered a stroke as a result. The stroke caused our client severe deficits and ended his career as a truck driver.
